Adventurebase GmbH (hereinafter referred to as Adventurebase)

The deliveries, services, offers and arrangements made by Adventurebase are based exclusively on these terms and conditions. By ordering a voucher or registering for an experience, these terms and conditions are deemed to have been accepted. The order or registration can be made in writing or verbally. General terms and conditions of the buyer are hereby rejected.

Adventurebase organizes and arranges experiences throughout Switzerland and nearby countries for various operators. The bookings are made through the sale of value vouchers or through direct placement.

Only value vouchers are available. The value is shown on the invoice and can be requested at any time. Value vouchers can be freely credited to any Adventurebase offer within the validity period. An offer chosen by the customer can be printed and described on the voucher, but this is not binding for redemption.

4.1 Brokerage contract
The brokerage contract is created when the buyer places an order or registers on the website and accepts the general terms and conditions. An order by telephone or e-mail replaces the order by online form. The organizer alone is responsible for the implementation. In this case, Adventurebase is the intermediary and not the organizer. When registering for the experience, the customer receives the organizer's contact details and concludes a separate contract with the organizer regarding the implementation. This contract for the use of the respective experience is concluded directly between the participant in the experience and the respective experience partner (organizer). The legal relationship between the customer and the experience partner (organizer) is governed exclusively by the general terms and conditions of the experience partner. Value vouchers are credited to the offer of the experience partner.

4.2. Sales documents
The information in our sales documents (descriptions, drawings, illustrations, dimensions, weights and other services) are only to be understood as approximate values and do not constitute a guarantee of properties unless they are expressly designated as binding in writing. Adventurebase accepts no responsibility for product information provided by partners.

Prices are subject to change and printing errors excepted.

6.1 Payment for vouchers
Payment for vouchers is made by invoice or online payment. Vouchers can only be credited to an offer once the full invoice amount has been received. In this case, the payment term of the invoice remains the same.

6.2 Payment of registrations
Payment for direct registrations is made by invoice or online payment and must be made at least 3 days before the event. If the customer fails to make the payment on time, Adventurebase may cancel the activity. In this case, however, the customer is not released from his contractual obligations of registration and the cancellation fees will be charged.

6.3. payment from abroad
The bank charges for a bank transfer from abroad shall be borne by the customer. The voucher or registration will not be activated until the invoice amount has been paid in full.

7.1 Validity of vouchers
The value of the voucher remains valid for up to 10 years in accordance with the Swiss Code of Obligations. During these 10 years, each voucher can be credited to any Flightbase and Adventurebase offer.

7.2. Extension
The value of the voucher can be extended free of charge in steps of one year up to a maximum of 10 years.

7.3. Cash payment
A cash payment of the voucher amount is not possible.

7.4. Transferability
The vouchers are freely transferable and are not issued to a specific person. In the event of loss or theft of a voucher, Adventurebase accepts no liability for unlawful redemption.

7.5. Validity of registrations

7.5.1. Registrations with vouchers
Registrations with vouchers are valid for a maximum of 3 months after the registration date at the price paid. In the event of a later execution, the difference between the voucher and the current offer price must be paid.

7.5.2 Registrations without a voucher
Registrations without a voucher will be executed at the paid price for a maximum of 3 months after the registration date. In the event of later execution, the difference to the current offer price must be paid.

8.1 Shipping costs Switzerland
Shipping costs for the voucher dispatch in Switzerland are borne by Adventurebase. There are no extra costs for the customer.

8.2 Shipping outside Switzerland
Vouchers are available abroad as a download. No vouchers will be delivered abroad by post.

.3. delivery and performance time
Dates and delivery periods are non-binding, unless expressly agreed otherwise in writing. The indication of certain delivery periods and delivery dates by Adventurebase is subject to the correct and timely delivery to Adventurebase by suppliers and manufacturers.

8.4. default of acceptance
If the buyer refuses to accept the delivery items after expiry of a grace period set for him or declares that he does not wish to accept the goods, Adventurebase may refuse to fulfill the contract and claim damages for non-performance. Adventurebase is entitled to demand either a lump sum of 25% of the agreed purchase price or compensation for the actual damage incurred from the buyer as compensation.

8.5. defects
Visible differences in quantity must be reported to Adventurebase and the carrier in writing immediately upon receipt of the goods, hidden differences in quantity within 4 days of receipt of the goods. Complaints regarding damage, delay, loss or poor packaging must be made immediately upon receipt of the consignment.

8.6. Transfer of risk
The risk is transferred to the buyer as soon as the consignment has been handed over to the person carrying out the transport. If shipment is delayed or becomes impossible through no fault of our own, the risk shall pass to the buyer upon notification of readiness for shipment. The assumption of transportation costs by Adventurebase has no influence on the transfer of risk.

9.1 Return of vouchers
Vouchers can be canceled up to 20 days after the order date for a processing fee of CHF 25 per voucher. If the voucher has not yet been sent, the processing fee does not apply. The vouchers do not have to be returned.

9.2. Excluded from return
Products that are not directly related to the voucher cannot be returned.

9.3. Exchange / crediting of vouchers
The value of the voucher can be credited to a new voucher order or to a new registration for any Adventurebase offer during the validity period.

10.1 Registrations
Registrations are binding. To cover illness, accident, etc., we recommend that you take out travel cancellation insurance. The customer is responsible for taking out this insurance.

10.2. Cancellations and postponements of registrations
Dates can be canceled or postponed in writing using the relevant web form. Only written cancellations or postponements via the web form or by post will be accepted during business hours from 08:00 to 17:00 from Monday to Sunday. These must always include the ticket code or voucher code. Cancellations made outside of business hours will be dated to the next possible business time. The date of receipt of the declaration by Adventurebase is decisive.

10.2.1 Cancellation more than 48h before the date:
Processing fee of CHF 25.- / person (exception: CHF 30.- / person for all simulator offers)

10.2.2 Postponement more than 48h before the date:
Processing fee of CHF 25.- / person. (Exception: CHF 30.- / person for all simulator offers)

10.2.3 Cancellation or postponement between 48h and 24h before the date:
Fee of 30% of the total price.

10.2.4 Cancellation or postponement within 24h or less before the date:
Fee of 100% of the total price.

10.2.5 Special regulation for all river rafting, canoeing and canyoning offers:
- up to 28 days before the date of the activity: CHF 40.- / person
- 27 to 10 days before the date of the activity: 30% of the total price.
- 9 to 2 days before the date of the activity: 75% of the total price.
- Thereafter or in the event of a no-show on the event date: 100% of the full price.

In the event of partial cancellation of group reservations (reduction in the number of participants), the customer shall pay the following shares of the costs of the booked event per person of the customers/participants:
- up to 10 days before the event date: no costs
- 9 to 3 days before the event date: 75%
- 2 days or less before the event date: 100%

10.2.6 Special regulations for all dog sledding offers:
The following proportion of the costs will be charged to the customer for each cancellation:
- Up to 30 days before the start of the activity 25%
- 29 - 15 days before the start of the activity 50%
- 14 - 0 days before the start of the activity 100%

If the event cannot take place because the customer arrives late or does not show up at all, the customer will pay 100% of the agreed price. Additional costs incurred due to postponements or late arrival of the customer shall be borne by the customer. If the event starts later or ends earlier, there is no entitlement to a refund. If the customer changes the date of the activity up to 30 days before its start, a processing fee of CHF 50 per person will be charged. If the activity is rebooked later than 30 days before the original date, the cancellation conditions come into force.

10.2.7. special regulation for gypsy skiing, quad biking, house running, airboarding, snowshoeing:
29 - 20 days before the start of the activity 20%
19 - 10 days before the start of the activity 50%
9 - 4 days before the start of the activity 80%
3 days before the start of the activity 100%

10.2.8. Special regulation for overnight stays in igloos:
Up to 60 days before the event CHF 25.-
Up to 30 days before the event 10%
Up to 7 days before the event 50%
6-0 days before the event 100%

10.2.9. Special regulation for gold panning:
Dates can only be postponed or canceled with a valid medical certificate.

10.2.10. Special regulation for dredging:
The customer will be charged the following proportion of the costs for each cancellation/postponement: up to 20 days before the start of the activity 20%, up to 10 days before the start of the activity 30%, 5 days before the start of the activity 100%
The activity takes place in all weathers.

10.2.11. Special regulation for shooting courses:
Course cancellations without incurring costs are possible up to three weeks before the course is held. Course fees will not be refunded for cancellations made at shorter notice. Rebooking to a replacement person is possible at any time at no cost. The activity takes place in all weathers.

10.2.12. Special regulations for bungee jumping, canyon jump
Cancellations within 48 hours before the start of the activity are subject to a cancellation fee of 100%.

10.2.13. Special regulations for canyoning Amden
up to 30 days before the start of the activity CHF 30.-
30 - 20 days before the start of the activity CHF 250.-
19 - 10 days before the start of the activity 60%
from 9 days before the start of the activity 100%.


10.3 Group registrations

When registering for groups (several people), the person registering assumes responsibility for passing on these GTCs to all participants and is liable for any cancellation costs incurred by all participants.

10.4. Cancellation / postponement by Adventurebase
Adventurebase and its partners maycancelor postpone confirmed dates for important reasons (weather, number of participants, short-term cancellation of participants for technical reasons, safety reasons, etc.). Participants, short-notice cancellation of participants, technical reasons, safety reasons, etc.). Any additional costs for travel, meals, etc. shall be borne by the participant and will not be covered by Adventurebase. In the event of cancellation by Adventurebase, the dates will be postponed to a new date requested by the customer. An automatic postponement to the 2nd preferred date specified at the time of registration or a provisional reservation of the 2nd preferred date is not possible. A return of the voucher or ticket by the customer if the activity is canceled by Adventurebase and its partners is generally not possible. A refund is possible in exceptional cases if the customer cannot offer an alternative date. This circumstance must be stated at the time of registration.

11.1 Times and offer description
The times stated in the product descriptions and registration confirmations are approximate and may vary depending on weather, wind and safety reasons. The guide can also postpone the locations at short notice for weather and safety reasons. If an activity is canceled early by the customer, the activity is deemed to have been carried out. In special cases, the guide may terminate an activity early for safety reasons or due to the participant's condition, whereupon the activity is also deemed to have been carried out. If the participant arrives at the appointment under the influence of drugs or alcohol, the activity will be refused and the activity will be deemed to have been carried out.

11.2. weather decision
The weather decision, if necessary, will be communicated to the customer by the guide in accordance with the information in the confirmation email. If the weather is uncertain, the weather decision can also be made at short notice. The customer also has the opportunity to check the weather forecast with the guide before the actual weather decision is made.

11.3. Participant requirements
In order to participate in certain experiences, there are special physical requirements such as maximum body weight and maximum height. It is the participant's responsibility to check and comply with these requirements. The specific restrictions can be viewed for each experience. If a guest is rejected on site due to these physical requirements, the voucher or ticket and the entitlement to the booked experience will be forfeited.

12.1 General information
Most of the experiences on offer take place outdoors in nature and are dependent on wind and weather. Postponements can therefore always occur, even at short notice before the planned start of the activity. Safety is our top priority.

13.1 Deliveries
Complaints regarding damage, loss or poor packaging must be reported in writing to Adventurebase and the carrier immediately upon receipt of the goods, hidden quantity differences within 4 days of receipt of the goods.

13.2 Activities
If the customer has cause for complaint or suffers damage, this must be reported in writing to the executing body (organizer) within 5 days and confirmed. This confirmation is not an acknowledgement of guilt. The address of the responsible organizer can be requested from Adventurebase. The organizer will make every effort to remedy the situation within the scope of the event and the possibilities. If no or insufficient remedial action is taken or if the customer wishes to assert claims for damages, the claims must be submitted in writing to the organizer and a copy to Adventurebase within 2 weeks of the contractual end of the activity. The complaint must be accompanied by confirmation from the organizer and any evidence. All claims are forfeited if the complaint is submitted late or not submitted at all during the activity or if the claim is submitted late.

Non-occupational accident insurance (e.g. SUVA) and health insurance must be in place and are the responsibility of the participant and must be presented on site on request. Cancellation insurance is recommended and is the responsibility of the participant. 

15.1 Damages
Claims for damages arising from impossibility of performance, breach of contract, culpa in contrahendo and tort are excluded both against us and against our vicarious agents, unless intentional or grossly negligent action is involved. Liability claims arising from an experience must be addressed to the organizer. If a participant does not follow the instructions of the organizer, activity leader, etc., any liability on the part of the organizer shall lapse.

Trogen AR is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.

The legal relationship is subject to Swiss law. Should one or more provisions of these GTC be or become invalid and/or incomplete, the invalid and/or incomplete provision shall be replaced by a legally valid provision that comes as close as possible to the invalid and/or incomplete provision in terms of its effectiveness. The invalidity and/or incompleteness of a provision shall not affect the validity of the other provisions.
